Terms of service
Overview
Welcome to The Indigo House.
The terms “we”, “us” and “our” refer to The Indigo House. We operate this website and online store, including all related information, content, features, products and services made available through it.
Our store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products to you.
These Terms of Service, together with any policies referred to within them, set out the terms that apply when you access our website, use our services or purchase products from us.
By using our website or placing an order, you agree to these Terms of Service and our Privacy Policy.
Nothing in these Terms affects your statutory rights as a consumer.
1. Using our website
You may use our website only for lawful purposes.
When providing information to us, including when placing an order, you agree that the information you provide is accurate, current and complete.
You are responsible for maintaining the confidentiality of any account details or passwords associated with your use of our website.
2. Our products
We make every reasonable effort to display our products accurately.
However, colours and appearance may vary slightly depending on your device, screen settings and lighting.
Many of our products are made using traditional textiles, hand-finished techniques, block printing, vintage or recycled fabrics. As a result, small variations in colour, print placement, texture or finish may occur. Where applicable, these variations form part of the character of the product rather than being considered faults.
Product descriptions, prices and availability may be updated from time to time.
All products remain subject to availability.
Nothing in this section affects your statutory rights. Goods sold by us must be as described, of satisfactory quality and fit for purpose as required by UK consumer law.
3. Orders
When you place an order, you are making an offer to purchase the products in your basket.
After placing an order, you will receive an order confirmation by email.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or product-description error;
- payment cannot be authorised;
- we reasonably suspect fraudulent or unauthorised activity; or
- we are unable to deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the relevant amount.
Please check your order carefully before submitting it.
Your rights to cancel or return an order are explained in our Return & Refund Policy.
4. Prices and payment
All prices shown on our website are in pounds sterling (GBP) unless otherwise stated.
The total amount payable, including applicable delivery charges, will be shown before you complete your purchase.
You agree to provide accurate and authorised payment details when placing an order.
Prices, promotions and discounts may change from time to time, but any changes will not affect an order that has already been accepted.
If we discover an obvious pricing error after you place an order, we will contact you before fulfilling the order and give you the option to proceed at the correct price or cancel for a full refund.
5. Shipping and delivery
Delivery options, estimated delivery times and charges will be displayed at checkout or explained in our Shipping Policy.
We will take reasonable steps to dispatch orders within the stated timeframe.
Delivery times are estimates unless we expressly agree otherwise.
If there is a delay outside our reasonable control, we will contact you where appropriate and take reasonable steps to minimise the effect of the delay.
Under UK distance-selling rules, goods should generally be delivered within 30 days unless another timeframe has been agreed with the customer.
Risk in the goods passes to you when the goods come into your physical possession or the possession of a person you nominate to receive them.
6. Returns, refunds and cancellation
Your rights relating to returns, refunds and cancellation are set out in our Return & Refund Policy.
UK customers purchasing online generally have the right to cancel an eligible order within 14 days of receiving the goods, without giving a reason. Certain statutory exceptions apply.
Our additional 30-day returns policy does not reduce your statutory rights.
7. Intellectual property
Unless otherwise stated, the content on this website — including our branding, logos, text, photographs, graphics, designs, videos and other materials — belongs to The Indigo House or is used by us with permission.
You may view and use the website for your personal, non-commercial use.
You must not copy, reproduce, distribute, modify, commercially exploit or republish our content without our prior written permission, except where permitted by law.
Third-party trademarks and content remain the property of their respective owners.
8. Third-party services and links
Our website may contain links to or integrations with third-party websites, platforms or services.
We are not responsible for the content, availability or practices of third-party websites that we do not control.
If you choose to access a third-party service, you should review its own terms and privacy policies.
9. Shopify
Our store is hosted and powered by Shopify.
Shopify provides the ecommerce infrastructure through which our website and checkout operate.
Any purchase you make from The Indigo House is made directly between you and The Indigo House. Shopify is not the seller of our products.
10. Privacy
We process personal information in accordance with our Privacy Policy.
Shopify and certain service providers may process personal information on our behalf in order to operate our website, process payments, fulfil orders and provide other ecommerce services.
Please refer to our Privacy Policy for further information.
11. Reviews, feedback and submitted content
If you submit a review, photograph, comment or other content to us, you confirm that you have the right to provide that content and that it does not infringe the rights of another person.
You must not submit content that is unlawful, abusive, defamatory, misleading or otherwise inappropriate.
Where you give us permission to use content for marketing or promotional purposes, we may reproduce and display that content in connection with The Indigo House.
12. Errors and inaccuracies
Occasionally, information on our website may contain errors or omissions relating to product descriptions, pricing, availability, promotions, delivery charges or other information.
We may correct errors and update information where reasonably necessary.
Where an error affects an order you have already placed, we will contact you and explain your options.
13. Prohibited uses
You must not use our website:
- for unlawful purposes;
- to infringe intellectual-property rights;
- to transmit malicious software or code;
- to obtain or misuse another person’s personal information;
- to interfere with the security or operation of the website;
- to impersonate another person or business; or
- to engage in fraudulent or abusive activity.
We may restrict access to the website where reasonably necessary to protect our business, customers or systems.
14. Our responsibility to you
Nothing in these Terms excludes or limits liability where it would be unlawful for us to do so.
In particular, nothing in these Terms limits your statutory rights relating to goods that are faulty, not as described, of unsatisfactory quality or unfit for purpose.
We do not exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer using our products for personal purposes.
15. Events outside our control
We will not be responsible for delays or failures caused by events outside our reasonable control.
If such an event significantly affects your order, we will take reasonable steps to contact you and minimise any disruption.
Your statutory rights remain unaffected.
16. Severability
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
17. Changes to these Terms
We may update these Terms from time to time to reflect changes to our services, business practices or applicable law.
The version published on our website at the time you place an order will apply to that order.
18. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you will retain any mandatory consumer protections that apply where you live.
Nothing in these Terms prevents you from exercising any rights you have to bring proceedings in the courts available to you under applicable consumer law.
